1. Definitions
Owner means the individual who owns and operates Kiyora and is based in Illinois, United States.
Maintainers means the Owner and anyone authorized by the Owner to operate, maintain, support, moderate, improve, or enforce rules for Kiyora.
Kiyora, Software, Service, and Services mean the Discord bot known as Kiyora, including its related software, websites, features, commands, tools, integrations, Free Services, and Paid Services.
Website means kiyora.vip, where these Terms are displayed or otherwise made available.
Free Services means unpaid access to Kiyora.
Paid Services means paid features, upgrades, subscriptions, premium access, add-ons, and other paid benefits.
2. Acceptance of Terms
By accessing the Website or using Kiyora, you agree to these Terms.
If you use Kiyora for a server, business, organization, community, or group, you confirm that you have authority to accept these Terms for them.
In that case, “you” includes both you and the entity you represent.
Important: If you do not agree to these Terms, do not use Kiyora.
3. Eligibility
You must be at least 13 years old, or the minimum age required to use Discord in your country, whichever is higher.
You may use Kiyora only if you are legally allowed to enter into a binding agreement.
If you cannot legally enter into a binding agreement on your own, you may use Kiyora only with permission and involvement from a parent, guardian, or authorized representative.
4. Privacy Policy
Our Privacy Policy describes how we handle personal information. Your use of Kiyora is also governed by the Privacy Policy.
Important: If you do not agree to the Privacy Policy, do not use Kiyora.
5. Discord and Third-Party Services
Kiyora works through Discord and may depend on third-party services, including payment providers, hosting providers, APIs, and infrastructure providers.
Your use of Kiyora must comply with all applicable third-party terms and policies, including:
Kiyora is not owned, operated, endorsed, sponsored, or approved by Discord unless we expressly state otherwise.
We are not responsible for third-party services, including outages, errors, limits, fees, policy changes, enforcement actions, account restrictions, or service interruptions.
6. Accounts, Servers, and Access
You are responsible for anything you own, control, manage, configure, or have access to while using Kiyora.
You are responsible for actions taken through your accounts, servers, settings, permissions, and by people you allow to access them.
Kiyora is not responsible for issues caused by your setup, configuration, permissions, decisions, access, or anyone you allow to use your resources.
7. Free Services
Kiyora may offer Free Services with limits, restrictions, usage caps, reduced features, or lower priority.
We may change, restrict, suspend, remove, or discontinue Free Services at any time, for any reason or no reason, with or without notice.
We do not guarantee that Free Services will remain available, unchanged, or free forever.
8. Paid Services and Billing
8.1 Paid Services
Kiyora may offer Paid Services in 30-day increments unless otherwise stated at purchase.
Paid Services are purchased through Discord native payments. By purchasing Paid Services, you agree to pay all fees, taxes, and charges shown at purchase through Discord.
Paid Services may include limits, restrictions, server restrictions, account restrictions, usage caps, or other conditions.
Access to Paid Services may be delayed, changed, suspended, restricted, or removed if payment fails, is reversed, is disputed, is suspected to be unauthorized, or violates these Terms.
8.2 Promotions
We may offer promotions, discounts, coupons, trials, or limited-time offers from time to time.
Promotions are subject to the terms shown at the time of the offer. Unless stated otherwise, promotions are non-transferable, may not be redeemed for cash, may be limited to one use per person, account, server, or payment method, and may be changed or ended at any time.
If no promotion terms are shown, the promotion is provided at our discretion and may be refused, modified, or withdrawn where allowed by law.
8.3 Payment Processors
Payments are processed through Discord. Your use of Discord payments is subject to Discord’s own terms, rules, fees, and requirements.
We are not responsible for Discord payment errors, outages, delays, declined payments, holds, reversals, account restrictions, or processor decisions.
8.4 Refunds
Refunds for Paid Services purchased through Discord are handled in accordance with Discord’s payment and refund policies where applicable.
You may contact us through our Contact page for billing questions or to request a refund review. Refunds are not automatic. A Maintainer will review the request in good faith and decide whether it meets our refund requirements or applicable law.
Approved refunds are returned through Discord or the original payment method when possible. Refund eligibility may depend on whether the Paid Service was delivered, used, abused, disputed, purchased fraudulently, or otherwise affected by a violation of these Terms.
If the refund requirements are not met, the payment is not refundable unless applicable law requires otherwise.
8.5 Billing Issues
If you have a billing issue, payment error, duplicate charge, failed payment, missing paid access, or other payment-related problem, contact us through our Contact page.
We may review billing issues in good faith, but we do not guarantee a refund, credit, extension, replacement, or adjustment.
8.6 Cancellations and Expiration
Paid Services in 30-day increments expire at the end of the paid period unless renewed, extended, or otherwise stated at purchase.
If a Paid Service renews automatically, you are responsible for canceling future renewals through Discord or the applicable platform.
Canceling stops future paid periods. It does not automatically refund the current paid period unless our refund requirements are met or applicable law requires otherwise.
8.7 Shipping, Delivery, and Returns
Kiyora provides digital services only. We do not sell or ship physical goods.
Paid Services are delivered digitally through Discord, the Website, or other supported online systems. Delivery may occur automatically after payment, but access may be delayed if payment review, fraud checks, Discord issues, configuration issues, or technical problems occur.
Because Kiyora sells digital access and not physical goods, there are no physical returns. Refund requests are handled under Section 8.4.
8.8 Paid Service Changes
We may update, change, limit, suspend, remove, replace, or discontinue any Paid Service at any time, for any reason or no reason, with or without notice.
We do not guarantee that any Paid Service, feature, upgrade, add-on, or benefit will remain available or unchanged.
Unless applicable law requires otherwise, changes, removals, suspensions, discontinuation, loss of access, or termination of Paid Services do not entitle you to a refund.
8.9 Chargebacks and Payment Disputes
Unauthorized, abusive, fraudulent, or bad-faith chargebacks or payment disputes are not allowed.
This does not limit any lawful payment dispute rights you may have.
If you submit a fraudulent, abusive, or bad-faith chargeback or payment dispute, or use a dispute to avoid paying for Kiyora, it is a violation of these Terms.
Violations may result in suspension, termination, blacklisting, loss of Paid Services, denial of future purchases, refusal of support, or other action we consider appropriate.
9. Ownership and Intellectual Property
Kiyora, including its software, branding, website, features, designs, and related materials, is owned by us or our licensors.
These Terms do not give you ownership of Kiyora or related materials.
You may not copy, modify, sell, distribute, reverse engineer, or misuse Kiyora unless we give written permission or applicable law allows it.
You may not use Kiyora’s name, branding, logos, or visual identity in a way that suggests sponsorship, endorsement, affiliation, or ownership without our written permission.
10. Service Availability
Kiyora is provided “as is” and “as available.”
We do not guarantee that Kiyora will be available, uninterrupted, secure, error-free, accurate, compatible with your setup, or available in any specific form.
Kiyora may depend on Discord, third-party services, payment processors, hosting providers, and other systems we do not control.
Third-party changes, outages, limits, removals, policy updates, enforcement actions, bugs, payment issues, or Discord changes may affect Kiyora.
11. Acceptable Use
You may not use Kiyora to break the law, violate Discord’s rules, violate third-party terms, abuse others, send spam, distribute malware, exploit bugs, overload systems, bypass restrictions, avoid payment, abuse refunds or disputes, resell Kiyora without permission, or interfere with Kiyora’s operation.
You are responsible for how Kiyora is used in any server, account, or system you control or manage.
12. Legal and Export Restrictions
You may not use, purchase, access, or receive Kiyora if doing so would violate applicable laws, sanctions, export controls, Discord rules, payment processor rules, or third-party terms.
You are responsible for making sure your use of Kiyora is legal in your location and for your intended use.
13. User Content
You are responsible for any content, data, commands, messages, settings, or materials submitted to or used with Kiyora.
You keep ownership of your content, but you allow us to use, process, store, display, and transmit it as needed to operate, provide, improve, protect, support, and enforce rules related to Kiyora.
We are not responsible for user content or for how users configure or use Kiyora.
14. Bot Output and Automated Actions
Kiyora may produce automated outputs, logs, responses, moderation results, role changes, permission changes, or other effects based on commands, settings, permissions, integrations, or user activity.
We do not guarantee that any output, action, result, or decision from Kiyora will be accurate, complete, appropriate, safe, or error-free.
You are responsible for reviewing, configuring, and deciding how to use Kiyora’s outputs and actions.
15. Disclaimers
Kiyora is provided without warranties of any kind, whether express, implied, or statutory.
We do not promise that Kiyora will meet your needs, be secure, be uninterrupted, preserve data, prevent issues, produce specific results, or remain available.
To the fullest extent allowed by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
16. Limitation of Liability
To the fullest extent allowed by law, Kiyora, the Owner, and the Maintainers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes damages related to your use of Kiyora, loss of access, lost data, lost revenue, service issues, payment issues, third-party services, or Discord.
To the fullest extent allowed by law, our total liability for any claim related to Kiyora will not exceed the amount you paid to Kiyora in the 30 days before the claim, or $50, whichever is greater.
17. Indemnification
You agree to defend, indemnify, and hold harmless Kiyora, the Owner, and the Maintainers from any claims, damages, losses, liabilities, costs, or expenses arising from your use of Kiyora, your content, your server, your configuration, your payment activity, your violation of these Terms, your violation of any law, or your violation of any third-party rights, terms, or policies.
18. Suspension, Termination, and Blacklists
We may suspend, restrict, terminate, blacklist, or remove your access to Kiyora at any time, for any reason or no reason, with or without notice, to the fullest extent allowed by law.
If you are suspended, terminated, or blacklisted, you may not use Kiyora again without our written permission.
You must stop using Kiyora and anything related to the Service after suspension, termination, or blacklist.
We are not required to restore access after suspension, termination, blacklist, or removal.
Unless applicable law requires otherwise, suspension, termination, blacklist, removal, or loss of access does not entitle you to a refund.
19. Changes to Kiyora and These Terms
We may update, change, suspend, restrict, remove, replace, or discontinue Kiyora or any part of it at any time, for any reason or no reason, with or without notice.
We may update these Terms from time to time. The updated version will be posted on the Website with a new Last Modified Date.
Your continued use of Kiyora after changes are posted means you accept the updated Terms.
20. Severability
If any part of these Terms is found invalid, illegal, or unenforceable, that part will be limited or removed only as much as necessary.
The rest of these Terms will remain in effect.
21. Assignment
We may assign, transfer, or delegate our rights and obligations under these Terms as part of a merger, acquisition, sale, restructuring, change of control, operation of law, or as otherwise allowed by law.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law rules, except where applicable law requires otherwise.
Any dispute arising from these Terms or Kiyora that is not resolved informally will be brought in the state or federal courts located in Illinois, except where applicable law requires otherwise.
